HEARING OFFICER ORDER
 
On September 29, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that this matter is related to an enforcement matter. The
parties represented that they anticipate that many of the issues in this matter will be resolved
through future settlement discussions. The parties made a joint oral agreement that the record in
this matter will not be due until December 6, 2004. The parties’ agreement is accepted and the
record is now due to be filed on or before December 6, 2004. Finally, the petitioner represented
that it will file a waiver of the statutory decision deadline.
 
 
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 4, 2004, at 10:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
