ORDER OF THE BOARD (by M. McFawn):
On August 11, 1998, the parties filed a Joint Motion to Stay Proceedings in this case,
seeking a stay to facilitate settlement negotiations. The parties seek an indefinite stay of
proceedings, which the Board will not grant. To facilitate the amicable settlement of this case,
however, the Board will grant the parties a temporary reprieve within which they may attempt
to reach an agreement.
This case is hereby stayed for 90 days, until November 18, 1998. The Board notes that
two motions are pending in this matter: White & Brewer Trucking, Inc.’s Motion for Partial
Summary Judgment and Motion for Entry of Scheduling Order. The parties state that, by
agreement, Environmental Site Developers, Inc. has not filed responses pending the Board’s
ruling on the motion for a stay. Unless this case is settled, responses to the pending motions
must be filed on or before November 25, 1998.
