    HEARING OFFICER ORDER
     
    On September 23, 2004, the parties participated in a telephone status conference with the
    hearing officer. The parties have reached a settlement agreement, but are still working on some
    final paperwork. Petitioner hopes to file a motion to dismiss before the next status conference.
    Additionally, petitioner agreed to file an open waiver of the decision deadline within the next
    thirty days.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:30 a.m. on December 21, 2004. The status conference shall be initiated by the
    petitioner.
     
    The statutory decision deadline for this case is February 7, 2005.
