    HEARING OFFICER ORDER
     
    On September 21, 2004, the parties participated in a telephone status conference with the
    hearing officer. Petitioner agreed to file a 40-day waiver of the decision deadline within the next
    seven days. Accordingly, the hearing officer agreed to extend deadlines for filing the
    administrative record and response to respondents motion to dismiss to October 19, 2004. As a
    practical matter, respondent is sending petitioner a proposed settlement letter within the next
    seven days, and petitioner will likely accept the offer. The parties hope to have this case
    resolved before the next status conference. Additionally, respondent does not object to
    petitioner’s motion to consolidate this docket with PCB 04-190, and does not plan to file a
    response to the motion.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:30 a.m. on October 12, 2004. The status conference shall be initiated by the
    petitioner. At the status conference, the parties must be prepared to discuss the status of the
    above-captioned matter and their readiness for hearing.
     
    The decision deadline in this case is December 16, 2004.
