HEARING OFFICER ORDER
On September 23, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that the respondent issued a modified draft permit
addressing two of the three outstanding issues. The respondent represented that it will draft a
permit addressing the remaining issue and, if approved, will go to publication.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 22, 2004, at 10:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further order.l
