ORDER OF THE BOARD (by G.T. Girard):

On July 20, 1998, the City of Belleville filed a request for an adjusted standard. The

caption on that filing indicated that the request for an adjusted standard was from 35 Ill. Adm.

Code 106.705; however, 35 Ill. Adm. Code 106.705 is the procedural rules detailing the

contents of the petition for an adjusted standard. The Board on its own motion corrects the

caption in this order to indicate that the adjusted standard is sought from 35 Ill. Adm. Code

306.305. On August 3, 1998, the petitioner filed a certification of publication.

The Board cannot, however, accept the petition at this time. The petition has not

adequately addressed the informational requirements of 35 Ill. Adm. Code 106.705.

Specifically, the petition fails to:

1.

provide the information concerning the number of persons employed at

the facility (See Section 106.705(d));

2.

provide a narrative description of the adjusted standard or proposed

language for the Board order (See Section 106.705(f)); and

3.

provide an explanation as to how it seeks to justify the proposed adjusted

standard pursuant to the requirements of Section 28.1 (c)(1)-(c)(4) of the

Environmental Protection Act (415 ILCS 5/28.1(c)(1)-(c)(4)) (See

Section 106.705(h)).

The Board therefore directs the petitioner to file an amended petition addressing these

areas by September 8, 1998, or this petition will be dismissed.
