    HEARING OFFICER ORDER
     
     
    On September 16, 2004, the parties participated in a telephone status conference with the
    hearing officer. In light of the Board’s ruling today on the motions partial summary judgment,
    the parties believe that the remaining issues may be resolved as permit conditions. Petitioner
    agreed to file a 60-day waiver of the decision deadline within the next seven days.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 3:00 p.m. on October 5, 2004. The telephone status conference will be initiated by the
    petitioner
     
    The statutory decision deadline is currently December 31, 2004, which would require the
    Board to decide this matter at its meeting on December 16, 2004.
