HEARING OFFICER ORDER
On September 16, 2004, all parties participated in a telephonic status conference with the
hearing officer. T parties informed the hearing officer that the settlement discussions continue
and will know in the near future whether this matter will be resolved without the necessity of a
hearing. The petitioner represented that it will file a 40-day waiver, to and including February 9,
2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on September 30, 2004, at 10:15 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
