    HEARING OFFICER ORDER
     
    On September 16, 2004, the parties participated in a telephone status conference with the
    hearing officer. Petitioner believes this case may be ready to dismiss. By September 22, 2004,
    petitioner will file either a motion to dismiss or an additional 90-waiver of the decision deadline.
     
    If petitioner’s motion to dismiss has not been filed, the parties are directed to participate
    in a telephone status conference with the hearing officer at 10:30 a.m. on November 17, 2004.
    The status conference shall be initiated by the petitioner.
     
    The statutory decision deadline for this case is currently December 22, 2004.
