HEARING OFFICER ORDER

On August 26, 2004, a telephonic status conference was held. Respondent did not

appear. The petitioner represented that it will have internal discussions regarding the related

adjusted standard matter that the respondent did not recommend. The petitioner represented that

it will file a waiver of the statutory decision deadline to and including January 7, 2005.

Respondent is reminded to file its appearance.

The parties or their legal representatives are directed to participate in a telephonic status

conference with the hearing officer on September 30, 2004, at 11:00 a.m. The telephonic status

conference must be initiated by the petitioner, but each party is nonetheless responsible for its

own appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing.
