HEARING OFFICER ORDER

On August 31, 2004, the parties participated in a telephone status conference with the

hearing officer. Respondent’s attorney hopes to schedule a meeting with its technical unit within

the next two weeks to determine how petitioner should proceed with the site clean-up. Once the

plan is in place, petitioner may move to dismiss this appeal.

The parties are directed to participate in a telephone status conference with the hearing

officer at 10:30 a.m. on October 14, 2004. The telephone status conference will be initiated by

the petitioner. At the status conference, the parties must be prepared to discuss the status of the

above-captioned matter.

The petitioner has filed an open waiver of the decision deadline in this matter.
