    HEARING REPORT
     
    On August 27, 2004, a hearing in this matter was held at the Vermilion County
    Courthouse Annex in Danville, Vermilion County. Attorney Jennifer Riggs appeared on behalf
    of complainant. Attorney John Martin appeared on behalf of respondent.
     
    Witness Credibility
     
    2 witnesses testified during the hearing:
     
    Mr. Douglas Toole
    Mr. David Phillips
     
    Based upon my legal judgment, experience, and observations at hearing, I find that the
    credibility of witness is not an issue in this matter.
     
    Exhibits
     
    Six photographs of the site were admitted as evidence at hearing. Exhibits 1-3 were
    offered by complainant, and exhibits 4-6 were offered by respondent. Neither party objected to
    the admission of any exhibits.
     
    Briefing Schedule
     
     
    Complainant’s brief is due September 29, 2004. Respondent’s brief is due
    October 20, 2004. Complainant’s reply is due October 27, 2004. The mailbox rule will apply.
    The complete transcript is due September 8, 2004.
