HEARING OFFICER ORDER
On August 26, 2004, all parties participated in a telephonic status conference with the
hearing officer. The complainant represented that the Illinois Environmental Protection Agency
has referred another alleged and minor violation. To that end, the complainant intends to file a
motion for leave to amend the complaint and incorporate it in the existing stipulation and
proposal for settlement (stipulation). The parties represented that they will continue to discuss
settlement in the interim.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on October 28, 2004, at 11:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a stipulation is filed
prior to the next status conference, the conference will be cancelled without further order.
