    HEARING OFFICER ORDER
     
     
      
    On August 26, 2004, all parties participated in a telephonic status conference with the
    hearing officer. The complainant represented that settlement discussions are not going as well as
    anticipated. A proposed revised discovery schedule between respondent The Highlands, L.L.C.
    (Highlands) and the complainant was submitted and is accepted to the extent as follows: written
    responses for all outstanding written discovery must be served on or before December 31, 2004;
    complainant must disclose its opinion witnesses and opinions on or before December 31, 2004;
    respondent Highlands must disclose its opinion witnesses and opinions on or before January 31,
    2005; all depositions to be completed on or before April 29, 2005; any further written discovery
    must be served on or before May 31, 2005; and responses to written discovery must be served on
    or before June 30, 2005. The complainant and respondent Murphy Farms, Inc. (Murphy Farms)
    to submit its discovery schedule at the next status conference. The attorney for respondent
    Murphy Farms made an oral motion for time to file its answer to the complainant’s second
    amended complaint to and including October 11, 2004. The complainant had no objection. That
    motion is granted.
     
    The parties are directed to participate in a telephonic status conference with the hearing
    officer on October 21, 2004, at 10:30 a.m. The status conference must be initiated by the
    complainant, but each party is nonetheless responsible for its own appearance. At the status
    conference, the parties must be prepared to discuss the status of the above-captioned matter and
    their readiness for hearing.
