HEARING OFFICER ORDER
On August 26, 2004, all parties participated in a telephonic status conference with the
hearing officer. Petitioner represented that the related to an enforcement matter that is also
before the Board is in its final stages of settlement and remains optimistic that it will be resolved
without the necessity of a hearing. Once the enforcement matter is resolved, petitioner
represented that it will proceed in this matter. Petitioner represented that it will file a 60-day
waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on October 28, 2004, at 10:00 a.m. The status conference
must be initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
