HEARING OFFICER ORDER

 

On August 24, 2004, the parties participated in a telephone status conference with the

hearing officer. The parties have begun the preliminary matters required for resolution of this

complaint under the Comprehensive Environmental Response Compensation and Liability Act

(CERCLA). Complainant sent notice to USEPA and the United States Attorney General, and

expects to file a CERCLA complaint with the federal district court by the end of October, 2004.

All interested parties will then meet to negotiate settlement terms, and complainant may proceed

to dismiss this Board docket.

 

The parties are directed to participate in a telephone status conference with the hearing

officer at 10:30 a.m. on December 2, 2004. The telephone status conference will be initiated by

the complainant.
