Complainant,CDOE, is a
unit
oflocal government towhich the Illinois
Environmental Protection Agency has delegated authority to issue administrative citations
pursuant to Section 4(r) ofthe Illinois Environmental Protection Act (“Act”), 415 ILCS
5/4(r)
(2004).
CDOE is thus a “delegated unit” and may issue administrative citations under 35
Ill.
Adm. Code
108.200.
2.
Respondent BOVIS engages in waste disposal activities and is
a Florida
corporation registered in Illinois and doing business in Illinois
3.
On July 20, 2004, CDOE inspector Lafayette Robertson inspected the site
approximately one block east ofthe excavation at 2011
W.
Roosevelt Road.
A copy ofhis
inspection report is attached as Exhibit
1
and made a part ofthis Administrative Citation.
Inspector Robertson observed general construction and demolition debris and litter in a pile
rising approximately forty feet.
The general construction and demolition debris and litter was
visible by the public and included but was not limited
to soil, wood, concrete, and bricks.
Inspector Robertson spoke to BOVIS
employees Doug Maddrill and Daniel Jedrzejowski who
admitted that BOVIS created the above pile.
4.
Based upon direct observations made by Mr. Robertson during the course ofhis
inspection, CDOE has determined that Respondent violated the Act as follows:
a.
Respondent caused or allowed the open dumping ofwaste in a manner
resulting in litter, in violation of Section 21Q)(1) ofthe Act, 415 ILCS
5/21Q)(1)
(2004).
b.
Respondent caused or allowed deposition ofgeneral construction or
demolition debris in violation of Section 21Q)(7)(i) ofthe Act, 415 ILCS
5/21Q)(7)(i)
(2004).
5.
Mr. Robertson’s affidavit, attesting to his material
actions and observations, is
attached as Exhibit 2 and made a part ofthis Administrative Citation.
6.
Based upon the foregoing facts, under Section
42(b)(4-5)
ofthe Act,
415 ILCS
5/42(b)(4-5) (2004), Respondent is subject to a civil penalty ofOne Thousand Five Hundred
Dollars
($1,500.00)
for each ofthe violations
identified above, for a total civil penalty of Three
Thousand Dollars ($3,000.00).

payment is due and including the date that payment is received.

If any civil penalty and/orhearing costs are not paid within the time set by the
Board in its final order,
the Office ofthe Illinois Attorney General and/or the Cityof Chicago

At all times relevant to the above-captioned Administrative Citation, Affiant was
employed as a senior environmental inspector by the City ofChicago Department of
Environment.

On July 20, 2004 between

a.m. and 11:30 a.m., Affiant conducted an
inspection ofthe property approximately one block east of the excavation at 2011
West
Roosevelt Road, Chicago, Illinois.
3.
Affiant conducted an onsite inspection, which included driving and walking
around the site and photographing the site.
4.
In connection with this inspection, Affiant completed the Inspection Report
appended to and made part ofthe above-captioned Administrative Citation, which is an accurate

We observed the following:

Roosevelt Rd. The site is will be the New Federal Bureau of Investigations

Approximately one block east ofthe excavation at 2011
W. Roosevelt
Rd. a stock pile ofwaste construction debris approximately
40-45
in
height. The waste pile mound consist oftires, wood

brick ,broken
concrete, stone, rod-Iron, various scarp metals, plastics, auto seats,
clay, and dirt approximately 66,000 cubic yards.

The waste construction debris mound is located less than a

ft. from Chicago Advocacy Center
School
for Sexual Abuse Children

We spoke with the site Superintendent Doug
Maddrill

Project Manager Daniel

both men are employees of
Bovis Lend Lease a Construction company.

Both mangers stated they were told by the city employee unknown
to dump and store the waste construction debris without a permit at
the 2011
W. Roosevelt Rd. vacant
lot

managers that a permit is needed for a transfer station operation and
height requirements needed to be met.

Mission:
The
Chicago
Children’s
Advocacy
Center
(CCAC)
coordinates,
supports,
and
participates
in
an
interdisciplinary response
to
child
abuse
victims
and
their families
in a child-friendly environment that ensures children’s safety,
healthand well-being.
The
CCAC accomplishes its mission by:
providing healing services, including crisis intervention, interviewing,
advocacy,
and treatment for children and their families;
providing
outreach and education
to
deepen the community’s under-
standing of the causes and consequences of child
abuse
and stimu-
late
community participation
in caring for Chicago’s abused children;
and
-
.
providing
a
physical and
professional environment
that supports the
work of the agencies charged with responding to child abuse.
Child Sexual
in
Chicago alone, over 3,000 children each year allege sexual abuse.
Each
Abuse:
case must be investigated
to
make sure the
child is safe from further abuse.
Child
sexual
abuse
can
be
devastating
to children.
Emotionally,
children
can
experience
withdrawal,
post-traumatic
stress
disorder,
and
feelings
of
shame,
distrust,
and
guilt.
As. adults,
sexually
abused
children
can
be
at
greater riskfor suicide, criminality, substance abuse and
other problems.
Member
No one
agency or
professional alone
can
prevent and
treat the
problem of
Agencies:
child
sexual
abuse;
a
multi-disciplinary
response
is
necessary.
The
CCAC
has
developed
a collaborative
partnership
between
law enforcement,
child
protective
services,
prosecution,
mental
health
and
the medical
community
to serve the best interests of the child.
The
CCAC is a
child-oriented
facility
that
houses staff from
agencies
with
primary responsibility for investigating abuse related
crimes against children:
the
Chicago
Police
Department,
the
Illinois
Department
of
Children
and
Family Services and the Cook County State’s Attorney’s Office.
The Center
also has a
pediatric medical clinic for abused children, operated by the Cook
County Bureau of Health Services.
Services:
The CCAC provides
intensive
advocacy
and
services
for sexually
abused
children,
including
court
accompaniment
and
education,
linkage
to
social
services
and
mental
health
resources
and
crisis
intervention.
Support
groups and child
life services are also available.
Location:
The
CCAC is located at 13” Street
and S.
Damen Avenue, on the Southwest
side
of Chicago.
The
facility
is
in
the
Illinois
Medical
District,
near
Cook
County Hospital and
the Cook County Juvenile
Court complex.
The Center
began
serving children
in May 2001
