HEARING
OFFICER ORDER
On August 9, 2004, the Board concluded the seventh day ofhearings in this proceeding.
At that hearing, some ofthe participants suggested that additional hearings would be advisable.
The Illinois Environmental Protection Agency (Agency) disagreed.
At the close ofthe hearing, I
indicated that at this time it is unclear how productive additional hearings maybe.
Based on the
comments at hearing, the participants seem to be more focused on reviewing the current proposal
and discussing the current proposal with the Agency in order to
develop more comprehensive
comments for the Board.
Therefore, with the agreement ofthe participants, a date 45-days from
August 9, 2004,
will be set for the
filing ofcomments to be consideredby the Board prior to first
notice.
Ifat that time any ofthe participants believes additional hearings are still warranted, the
participants may renew their request for additional hearings at that time.
Participants, who wish to file comments to be considered by the Board prior to first
notice, shall file comments on or before September 23, 2004.
The comments must be in the
Board’s Chicago Office no later than 4:30 p.m.
September 23,
2004.
The mailbox rule does not
apply.
