I
am responding
to
your recent
phone
call regarding a
phone
conference on Felr~iary
10,
2003.
As
you know I left
a phone
message for
you
advising you
that
I
hadbeen in
the
hospital and did not get
home to
receiveyour message
until
February 8,
2003, and February
10,2003
was already spoken forfor
me with
medical treatment
appointments I had to honor.
I
also left a message that I
would
write
you last
week
advising
you of
days I would be
available for
a 3-way
telephonic
conference.
This
is the first
chance
I have had to
correspond with you.
On February 12, 2003
I had to
return
to the
hospital
to receive IV medications,
and transfhsions and was released
yesterday.
As
you know from prior correspondence, I
have
been quite ill.
It
has been very difficult for
me to do much right now.
I am not
staying at my home right now due to
requiring assistance and-having physical limitations.
I can provide
you
with
days
I
would hope
to be available to discuss this noise
complaint, and I understand that you and
the
Board needupdates and
need
to move the case along.
Perhaps
it
would
be better to shelve
this casefor
the
next
4-5
months,
as
I am having to travel
some distance out of town for
medical care andhospitalizations.
I am uncomfortable
committing
to
dates for calls
to
you
and possiblynot
able to follow through
due
to
health care
commitments that arise on my
behalf.
Unless Mr. OConnor and his
client have fixed the problem ofnoise
pollution
coming from the
roof
ofthe
school,
we will
need
to keep this case open to try
and
resolve the matter.
It is my
hope you
and
Board will be understanding
ofthe
circumstances.
People
get
sick, Mr.
Halloran.
Ifthe
school
had resolved the noise problem years
ago as I requested, I would not need
to be
spending
my
personal unpaid
time to put
this letter together, finding someone
to type it tbr me,
and even havingto deal with
this issue when I
should be
focusing on health
matters currently before me.
Please
advise at your convenience
on whether you
wish to try and
set-a-date for-a-phone-conference, with
the
understanding
that
I may
need
to
cancel
at late notice due to
health care
matters, or if~wshould delay
the matter for several
months until
my
health care improves and
we can move on this
casehopefully uninterrupted,
if
Respondent has
not
corrected
the
noise
problem as of thisdate.

I have enclosed a
letter
I mailed to you on February 19, 2003
still
in the enclosed envelope
which came
back to me.
As you
know,
and
will note from
the
enclosed letter,
I have
been
quite ill,
and thishas
taken up
most
ofmy
time and energy
in recovery.
As I looked at the envelope I realized that I made the mistake in the
address
explainingits
return
to me.
It was typed
1100
Randolph, and not
100 Randolph.
This
was
my mistake
and 1 take responsibility for it, and not getting correspondence to you
before now.
I had surgery again, on March 10, 2003
and I was released on March
15,
2003
and
when I arrived home I saw the returned
envelope in my mail.
I
am not sure what to do about pursuing this noise matter.
I will need you to advise me, or advise if I should contact Dorothy
Gunn
again.
I heard the ACnoise at the
school last night
so obviously Mr.
O’Connor
has
not convinced
his
client, Unit
5,
North PointeGrade School to silence or
buffer the AC fan
noise.
I had hoped
they
would take
care
of the problem during the
November
-
March months so
we could close
out thismatter
before us
with
the respondent.
Mr.
Halloran,
I would be happy to
discuss the AC noise problems with the newUnit
5
School Superintendent if he would like to fulfill the promise Unit
5
made to
me
in 2001
regarding the noise ifMr.
Steska is willingto correct the problem so we can
dismiss this
complaint.
Mr.
Steska, the
school
superintendent,
has
my permission to contact me to
discuss
the noise problems.
IfMr.
Steska chooses
not
to contact me to resolve the noise complaint, it is my
recommendation
that we sideline
this matter
for
the next
4-5
months until I know my health
is more predictable and
I can put forth the work necessary
to prepare for the
hearing, and
commit to further
phone
conferences with
all
parties.
Right
now,
I
an-i at the mercy of
doctor
appointments, and treatment
out of
town,
so there is a lot oftravel
time for
me,
and still
recovering while
under medications whichcan affect
my responses.
Perhaps
this
is
why
the address
mistake
was made on
your
envelope, as I may not have read it right while under medications.
I need to put my health first,
Mr. Halloran.
Obviously,
Unit
5
has
no interest in helping their neighbors,
and
correcting the noise problems
coming
from the school,
so the noise will remain
for us to pursue several months from nowwhen I have
medical
authorization to begin doing business work again associated
with
this
complaint.
I will apologize to you
and
the Illinois Pollution Control Board
only
for the continuance needed to finish this case.
IfUnit 5
would cooperate and control the AC fan
noise
they
have forced upon its neighbors I would not have to be takingpersonal
time
to
be contactingthe IPCB and fighting
with
Unit
5
when I should be focusing on my
health
concerns.
I will
await your recommendation on the next step for us to pursue.
