RE:
DCEO Response
to Request for Determination on Economic Impact Study
in
Rulemaking Docket R04-26
Dear Chairman Novak:
Thank you very much for your June
15, 2004 letter requesting a determination as to whether the
Department ofCommerce and Economic Opportunity intends to
conduct an economic impact
study ofthe proposed rules in the above-referenced
docket.
The Department has reviewed the interim phosphorus effluent standards (proposed
35
Ill. Adm.
Code 304.123(g-k)) that have been submitted to the Board by the Illinois
Environmental
Protection Agency.
Based on this review, and in light of continued fiscal constraints, the
Department has decided not to
conduct a study ofthe economic impact ofthe proposed rules,
pursuant to 415 ILCS
5/27(b).
Thank you for soliciting the Department ofCommerce
and Economic Opportunity’s input in this
matter.
Sincerely,
Jack Lavin, Director
Department ofCommerce and Economic Opportunity
