    HEARING OFFICER ORDER
     
     
     
    On July 29, 2004, the parties participated in a telephone status conference with the
    hearing officer. As background, this case alleges violations from incidents that occurred eight
    years ago, as well as violations occurring this year involving recordkeeping and failure to notify.
    In an effort to resolve both sets of alleged violations in one settlement agreement, respondent is
    preparing a letter to the Illinois Environmental Protection Agency (IEPA) that waives
    respondent’s rights pursuant to Section 31 of the Environmental Protection Act. Upon receipt of
    respondent’s letter, the IEPA will refer the more recently alleged violations to complainant.
    When that occurs, the parties will be able to continue settlement negotiations on all outstanding
    allegations.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:30 a.m. on October 28, 2004. The telephone status conference will be initiated by the
    complainant. The parties shall be prepared to discuss the status of this matter.
