HEARING OFFICER ORDER
On July 29, 2004, a telephonic status conference was held. Respondent did not appear.
Petitioner represented that it received a draft modified NPDES permit from the respondent for
review. The petitioner has reviewed and commented on it and on July 23, 2004, sent it to the
respondent for its review.
The parties are directed to participate in a telephonic status call with the hearing officer on
September 30, 2004, at 9:30 a.m. The status conference must be initiated by the petitioner, but
each party is nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness for
hearing. If, however, a motion to voluntarily dismiss is filed prior to the next status conference,
the conference will be cancelled without further notice.
IT IS SO ORDERED.
