(“Respondents”) of a facility located on the 1200 block of Airport Avenue,
Greenville, Bond County,
Illinois.
The
property
is
commonly
known
to
the
Illinois
Environmental
Protection
Agency
as
Greenville/Koch,
Lawrence.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and
is designated with
Site Code
No. 0050055073.
3.
That
Respondents have
owned and/or operated said
facility at all
times pertinent
hereto.
4.
That
on
June
15,
2004,
James
Balmer
of
the
Illinois
Environmental
Protection
Agency’s
Collinsville
Regional
Office
inspected
the
above-described
facility.
A
copy
of
his

inspection
report setting
forth the results of said
inspection
is attached
hereto
and
made
a part
hereof.
VIOLATIONS
Based upon direct observations made by James Balmer during the course
of his June
15,
2004
inspection
of
the above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that Respondents have violated the Illinois Environmental Protection Act (hereinafter,
the “Act”) as follows:
(1)
That
Respondents
caused
or allowed
the
open
dumping
of waste
in
a
manner
resulting
in
litter,
a
violation of Section
21(p)(1)
of the Act, 415
ILCS 5/2l(p)(l)
(2002).
(2)
That
Respondents caused
or allowed
the
open
dumping
of v~astein
a
manner
resulting
in
open
burning,
a
violation
of
Section
2I(p)(3)
of
the
Act, 415
ILCS
5/2l(p)(3) (2002).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415
ILCS 5/42(b)(4-5) (2002),
Respondents are
subject
to
a
civil
penalty of
One
Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations identified above, fora total of Three Thousand Dollars ($3,000.00).
If Respondents elect
not to petition the Illinois Pollution Control Board, the statutory civil penalty specified above shall be
due and payable
no later than August 31, 2004,
unless otherwise
provided by order of the Illinois
Pollution
Control
Board.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues afinding of violation as alleged herein, after an adjudicatory hearing,

Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution
Control Board.
Those hearing costs shall be assessed
in
addition
to
the One Thousand
Five
Hundred
Dollar ($1,500.00) statutory civil penalty for each
violation.
Pursuant to
Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1 (d)(1) (2002), if Respondents fail
to
petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days
of the date of service,
the Illinois
Pollution Control
Board
shall
adopt
a
final
order,
which shall
include
this Administrative
Citation and
findings
of violation
as
alleged herein,
and
shall impose the statutory civil penalty specified above.

On June
15, 2004, Kendall Couch
and I conducted an inspection at a property located on
the
1200 block ofAirport Avenue, Greenville, Illinois,
(N38.841068 W089.407413) in
response to a citizen complaint.
The complainant stated that used tires were transported
to
and burned on the property.
The complainant was concerned
that more burning would
occur.
The weather during this inspection was cloudy, about 85°Fahrenheit.
The owner,
Lawrence Koch, was not present during the inspection.
His mailing address is
526
Poplar, Highland, Illinois 62249.
We arrived at approximately 12:15 p.m. and walked around the property.
On the east
side ofthe property there were approximately 100-125 uncovered waste tires.
There
were truck, car and front tractor tires and inner tubes.
Water was found in many ofthe
tires and a mosquito larvawas
observed.
Several plastic containers with approximately
20 gallons ofdark, oil-like liquid were found near the tires.
A large shed was being
constructed
on the property about¼
mile from Airport Avenue.
To the north of the new
structure were two
(2) burn areas that had steel strands from radial tires, indicating tires
were burned.
To the south of the new structure were an unlicensed International flatbed
truck, a large burn pile and a smaller burn pile.
The large burn pile contained
approximately 22 cubic yards ofconstruction debris
(wood, asphalt shingles, packaging);
steel strands from radial tires, logs, plastics, cardboard, truck tires and fabric.
The pile
had burned material on the bottom.
The small burn pile contained about 10
cubic yards
oflumber, plastic, logs and steel strands from radial tires.
This pile also had burned
material on the bottom layer.
The inspection was completed at
12:5
0 p.m.
In a follow-up telephone conversation on June
16, 2004, Mr. Koch stated that he would
stop burning tires and construction debris.
He stated that he thought it was legal to burn
the tires and debris with the landscape waste.
He was informed that it was illegal
to burn
tires and
construction debris.
Mr. Koch is the owner of Larry’s Tire and Battery in Highland, Illinois (BOL#
1190550012).
This business is a tire retailer and storage site.

Apparent Violations
It appears that Mr. Lawrence Koch is in apparent violation of the Illinois Environmental
Protection Act for the following:
1.
Caused and allowed air pollution.
9(a).

Caused and allowed open dumping ofused tires and
other waste.

and 21(p)(3).

Recommendations
1.
Immediately cease all open dumping and
open burning.
Do not dispose of
any ofthe waste by open burning.

Remove all wastes, with the exception of logs, branches, leaves and
grasses, to
a permitted landfill or transfer station.

Do not dispose of any waste by open burning.
4.
Remove all waste tires to a registered tire storage or
tire disposal facility.
Used or waste tires cannot be taken to a landfill or transfer station for the
purpose ofdisposal.
