    HEARING OFFICER ORDER
     
     
    On July 22, 2004, the parties again contacted the hearing officer to modify the deadlines
    for the motions for partial summary judgment. The motions will now be due by July 30, 2004,
    and responses are due August 13, 2004. The mailbox rule will apply.
     
    Under the current decision deadline, this matter must be set for hearing no later than
    September 16, 2004, and a hearing would need to be held no later than October 14, 2004. The
    parties are advised that the Board may not rule on the summary judgment motions by that date.
    Accordingly, petitioner’s attorney should discuss additional waivers of the decision deadline
    with petitioner before the next status conference.
     
    The parties are reminded to participate in a telephone status conference with the hearing
    officer at 10:00 a.m. on August 3, 2004. The telephone status conference will be initiated by the
    petitioner
     
    The statutory decision deadline is currently December 31, 2004, which would require the
    Board to decide this matter at its meeting on December 16, 2004.
