    HEARING OFFICER ORDER

On July 22, 2004, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it is still reviewing petitioner’s proposal letter
and anticipates a response in the near future. If the proposal is accepted, the petitioner
represented it will file a motion to voluntarily dismiss this appeal.

The parties are directed to participate in a telephonic status conference with the hearing
officer on August 19, 2004, at 11:45 a.m. The telephone status conference will be initiated by
the petitioner, but each party is nonetheless responsible for its appearance. At the telephone
status conference, the parties must be prepared to discuss the status of the above-captioned
matter and their readiness for hearing.

    IT IS SO ORDERED.
