Dear Village President McBride:
The Agencyhas completed its technical review ofthe attached provisional variance
request submitted by the Village ofTilden on November
25,
2003.
Based on the review,
the Agency GRANTS the requested provisional variance subject to specific conditions
set
forth below for a period of
45
days.
The Village ofTilden seeks a provisional variance to replace existing pipes and valves in
the draw offstructures in both cells ofits wastewatertreatment facility.
The control
valves and piping in the draw offstructures
and the outfall pipe are severely deteriorated
making operation ofthe facility in a mannerto comply with discharge limitations
difficult, if not impossible,
under heavy flow conditions.
The Village intends to replace
the valves and pipes and has received an emergency
grant
from Department of
Commerce and Economic Opportunity for this project.
The Village will attempt to lower
the cell levels while maintaining compliance with the limits in its National Pollutant
Discharge Elimination System (“NPDES”) Permit 1LG580107 prior to the start of
construction.
Upon completion ofrepairs, the wastewatertreatment facility will be able
to
comply with the NPDES permit limits.
The Agency’s review ofthe requested provisional variance has concluded the following:
1.
The environmental impact from the proposed activity should be minimal;
2.
No other reasonable alternative appears available;
3.
No public water supplies should be affected;
4.
No federal regulations will preclude the granting ofthis request; and

5.
The Village will face an arbitrary and unreasonable hardship if the request
is
not granted.
The Agencyhereby GRANTS the Village ofTilden a provisional variance from

304.120(a) for CBOD5 and suspended solids for a period of45
days
beginning January 19, 2004, subject to the following specific conditions:
A.
During the variance period, the effluent from the Village’s wastewater
treatment facility shall meet monthly average concentrations of70 mg/l
for CBOD5 and 70 mg/i for
suspended solids.
B.
The Village shall notify Barb Conner ofthe Agency by telephone at
217/782-9720 when construction starts and again when construction is
completed.
Written confirmation of each notice shall be sent within five
days to the following address:

PROVISIONAL VARIANCE REQUEST
Dear Sir:

I amrequesting a Provisional Variance to allow the Village ofTilden to replace existing pipes and
valves in the draw offstructures in both cells ofthe wastewater treatment
facility.
The existing
pipes and valves leak making it difficult to control cell levels and the
level at which water is drawn
off the cells. The Village has received an emergency grant from Department of Commerce and
-
Economic Opportunity (DCEO) for this project and Construction Permit No. 2003-AB-5203
issued by the Permit Section forthis work.
The following is the information requested under Section l80.202.b Items 1-13.
1. The
Village ofTilden requests variance from NPDES Permit 1LG580107 CBOD5 and
Suspended Solids Concentration Limits.
The permit monthly average concentration limits
are
25
mg/i for CBOD5 and 37 mg/i for Suspended Solids.
The Village requests a variance
to increase the monthly average to
70 mg/I for CBOD5 and 70 mg/i for Suspended Solids.
2. The Tilden Wastewater Treatment Facility is located
in the NE 1/4 ofSection
7 T. 4 S.,

Principal Meridian in Randolph County.
The facility serves 940 people
and is designed for a PE of 1025.
3. The facility treats wastewater collected by the Tilden sanitary sewer collection system.
4.
A maximum of 10 million~
gallons ofwater with CBOD5 and Suspended Solids
exceeding the permit limits may be discharged. The Village
will attempt to
lower the cell
levels while maintaining compliance with permit limits prior to the start of construction.
This could lower the volume discharged under variance to approximately
3.5
million
gallons. The facility discharges to unnamed tributary to
Plum Creek to the Kaskaskia
River to the Mississippi River.

6. Adverse environmental impacts may be a temporary increase in CBOD5 and
Suspended
Solids
in the receiving
stream. The impact is expected to be minimal.
The facility may
have no discharge for 30 to 60 days after repairs are completed. Future discharges are
expected to be in compliance with permit
limits.
7. The control valves and piping in the draw offstructures
and the outfall pipe are severely
deteriorated making operation of the
facility in a manner to comply with discharge
limitations difficult, if not impossible,
under heavy flow conditions.
The Village desires to
replace the valves and pipes and has received an emergency grant from DCEO for this
purpose.
The draw offstructures are located in the lagoon cells. The cells need to be dewateredto
allow access by personnel and
equipment to complete the repairs.
8.
The facility will be able to comply with permit limits after the repairs are completed.
The repairs are expected to
be completed within 45 days or less
after the first cell is
dewatered.
9. The other alternative considered was installing sheet metal piling to provide a cofferdam
at eachdraw offstructure. This option will be expensive and could damage the cell bottom
seal allowing seepage from the lagoon cells into the soils beneath the cells.

10. The
Village requests the variance beginning January
19,
2004 for a period not to
exceed 45
days.
11. No provisional variances have been granted the Village ofTilden within the calendar
year.
12. Monthly samples have exceeded the permit
limits for Suspended Solids
five times in
the last
12 months and once for CBOD5. These were in months with high precipitation.
The condition ofthe existing pipes and valves in the draw offstructures does not
allow the
Village to regulate cell levels, draw offlevels and
flows to operate the facility efficiently.
13. There are no current Board Orders or matters
concerning the
Village ofTilden before
the Board.
