That Edward and Betty Jo Cain are the owners and Edward Cain d/b/a Cain Roofing
Company is the operator (collectively “Respondents”)
of a facility located
at
1102

Road 900
N, Tolono, Champaign
County,
Illinois.
The property is commonly known to the
Illinois
Environmental
Protection Agency as Tolono/Cain,
Ed.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and is designated with
Site Code
No. 0191005010.
3.
That Respondents have owned and operated said facilityatalltimespertinent hiereto.
4.
That
on
July
2,
2004,
Kenneth
Keigley
of
the
Illinois
Environmental
Protection
Agency’s
Champaign
Regional
Office
inspected
the
above-described
facility.
A
copy
of
his
inspection
report
setting
forth
the
results
of said
inspection
is attached
hereto
and
made
a part
hereof.
VIOLATIONS
Based upon
direct observations made by Kenneth Keigley during the course of his July 2,
2004
inspection
of
the above-named
facility,
the
Illinois
Environmental
Protection
Agency has
determined that
Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”)
as follows:
(1)
That
Respondents
caused
or allowed the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of Section
21(p)(1)
of the
Act,
415
ILCS
5/21(p)(1)
(2002).
(2)
That
Respondents
caused
or allowed
the
open dumping
of waste
in
a manner
resulting
in
open
burning,
a
violation
of
Section
21(p)(3)
of
the
Act, 415
ILCS
5/21 (p)(3) (2002).
(3)
That
Respondents
caused or
allowed the open
dumping
of waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction ordemolition debris, a violation of Section
21 (p)(7) of theAct, 415 ILCS
5/2l(p)(7) (2002).
CIVIL PENALTY
Pursuant to
Section 42(b)(4-5) of the Act, 415 ILCS
5142(b)(4-5)
(2002), Respondents are
subject
to
a
civil
penalty
of
One
Thousand
Five
Hundred
Dollars
($1,500.00) for
each
of
the
violations
identified
above,
for
a
total
of
Four Thousand
Five Hundred
Dollars
($4,500.00).
If
Respondents elect
not
to
petition the
Illinois
Pollution
Control
Board, the statutory
civil penalty

specified
above shall be
due
and
payable
no later than
September
15, 2004,
unless otherwise
provided by order of the Illinois Pollution
Control Board.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1
of the Act, 415

(2002), and if the Illinois
Pollution Control Board
issues a finding of violation as alleged
herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing
costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution
Control Board.
Those hearing costs shall be assessed
in
addition
to
the One Thousand
Five Hundred
Dollar ($1 ,500.00)
statutory civil penalty for
each
violation.
Pursuant to Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1 (d)(1)
(2002), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days

General Comments:
On July
2, 2004
at 09:45
A.M.,
I conducted
an inspection at the Edward Cain Roofing Company,
located at 1102 North County Road 900 N, Tolono, Illinois 61880.
This inspection was conducted in
response to
a complaint from IEPA, Champaign Region BOA, alleging that open dumping and open
burning were occurring on
this
site.
The purpose of this
inspection was
to
determine regulatory
status
and evaluate compliance with
the Illinois Environmental
Protection Act (Act) and Title 35
Illinois Administrative Code, Subtitle G: Land Pollution (Regulations).
The inspection consisted of
walking around the site and taking pictures, no one was present to representthe property owner. The
weather was sunny, the temperature

degrees.

The Roofing Company is owned by Mr.
Edward Cain, 807 West Church Street, Savoy, Illinois
61874.
The property
is owned by Mr.
& Ms Edward Cain, 807 West Church Street, Savoy,
Illinois 61874.
Findings:
When I arrived on
the property I entered
the property and traveled to
the north end ofthe lot.
I
saw an area measuring approximately 20’
x 20’ where the vegetation and ground had
been
charred and was black from open burning (see photos #2
and #5).
The blackened area was
covered by residue from open burning consisting ofashes, partially burned and charred
dimensional lumber, a heat scorched metal frame with springs from furniture, metal containers~
heat scorched roofing nails, and
partially burned shingles (see photos
#3
and
#4).
There was also
a pile ofdimensional lumber piled northwest of the burn pile
(see photo #3).
At the southwest
corner ofthe burn area I saw a pile of unburned shingles, measuring approximately 4’ x 4’ x
1’
which judging by their condition (torn, piled in a pile) were waste shingles (see photo #1).
I left
the site at 09:55
A.M.
Cain’s
Roofing had previously received a Non-Compliance Advisory (NCA)
from the
Champaign BOA dated August 23,
1999 and answered in a letter dated September
1,
1999,
signed
by Mr. Cain, stating that they would not open burn again (NCA and letter enclosed).

The local fire department filed two incident reports to the State Fire
Marshall’s Office dated
06/23
& 06/3 0, 2004 stating that
fires containing burning roofing materials consisting of wood
shingles,
tar buckets,
tar paper, plastic, metal,
and aerosol cans had been observed at this property
and extinguished on those dates (incident reports attached).
I have been unable
to contact Mr.
Cain for his comments on the open dumping/burning
incident
at his facility.
