HEARING OFFICER ORDER
On July 8, 2004, complainant and respondent Roberts Environmental Control, Inc.,
(Roberts) participated in a telephonic status conference with the hearing officer. It is noted that a
stipulation and proposal for settlement (stipulation) regarding Marc Reality, Inc., was filed with
the Board on May 25, 2004. The parties represented that settlement discussions continue.
Roberts represented that they anticipate filing an answer with affirmative defenses on or before
July 29, 2004. Complainant’s response to the anticipated affirmative defenses is due on or
before September 9, 2004.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on September 8, 2004, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
