    HEARING OFFICER ORDER
     
    On July 6, 2004, the parties participated in a telephone status conference with the hearing
    officer. As previously reported, the outcome of a related enforcement case filed in circuit court
    will likely render this permit appeal moot. However, petitioner cannot yet determine when the
    circuit court case may be resolved.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:30 a.m. on September 7, 2004. The call shall be initiated by petitioner.
      
    Petitioner filed an open waiver of the statutory decision deadline for this case .
