Michael
E.
Boone
(“Respondent”)
is the
present
owner of a
facility located
approximately 1.3 miles south of the Village of Bath, on the east side of Illinois Route 78 in Mason
County, Illinois.
The property is commonly known to the Illinois Environmental Protection Agency as
Bath Twp./Boone.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and
is designated with
Site CodeNo.
1258015002.
3.
That Respondent has owned said facility at
all times pertinent hereto.
4.
That on May 18, 2004, Charlie
King of the Illinois Environmental Protection Agency’s
Springfield Regional
Office inspected the above-described facility.
A copy of his inspection report
setting forth the results of said
inspection is attached hereto and made
a part hereof.
VIOLATIONS
Based upon direct observations made by Charlie King during the course of his May 18, 2004
inspection of the above-named facility, the Illinois Environmental Protection Agency has determined
that Respondent has violated the
Illinois
Environmental Protection Act (hereinafter,
the “Ad’) as
follows:
(1)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of
the Act, 415
ILCS 5/2l(p)(l)
(2002).
CIVIL PENALTY
Pursuant
to
Section
42(b)(4-5) of the Act, 415
ILCS
5/42(b)(4-5)
(2002),
Respondent
is
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dollars
($1,500.00) for each
of the
violations
identified
above,
for
a total of
One
Thousand
Five
Hundred
Dollars
($1,500.00).
If
Respondent elects
not to
petition
the
Illinois
Pollution
Control
Board,
the
statutory civil
penalty
specified above shall be due and payable no later than July
30, 2004 unless otherwise provided by
order of the Illinois
Pollution Control Board.
IfRespondentelects to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1

Operations Section ofthe Illinois Environmental Protection Agency and has been so
employed at all times pertinent hereto.

ofa disposal site operated without an Illinois Environmental Protection Agency permit,
located in Mason County,
Illinois, and known as Bath Twp.JBoone by the Illinois
Environmental Protection Agency.
Said site has been assigned site code number LPC#
1258015002 by the Illinois Environmental Protection Agency.

Affiant inspected
said Bath Twp./Boone open dump
site by an on-site inspection,
which included walking and photographing the site.

As
a result ofthe activities referred to in paragraph 3
above, Affiant completed the
Inspection Report form attached hereto and made a part hereof, which, to the best of
Affiant’s knowledge and belief, is an accurate representation ofAffiant’s observations and

NARRATIVE RE-INSPECTION REPORT DOCUMENT
The purpose ofthis memorandum is to
serve as the Narrative Re-inspection Report
Document ofa re-inspection conducted at the subject site on May 18, 2004 ~from
approximately
12:45
p.m. until 1:00 p.m., by this author.
The inspection was conducted
as a result ofa complaint received at the DLPC/FOS
—
Springfield Regional Office.
The
site was originally inspected on February 17, 2004, based on a complaint that was
received at the DLPC/FOS Springfield Regional Office.
That complainant alleged that
almost the entire ground that comprised the property at the site surrounding a double-
wide mobile home, was covered in assorted wastes, includingjunk vehicles, lawn
mowers, metals, wood, plastics, general household refuse, some burned, used tires,
concrete blocks, ajunk motorcycle, toys and other wastes.
The original inspection
substantiated the complaint and
an Administrative Citation Warning Notice (ACWN)
dated March
8, 2004,
was issued.
The ACWN was sent Certified Mail and was signed
for by respondent Michael Boone on March
10, 2004.
The ACWN clearly states that a
required response within 15 calendar days of the date ofthe notice.must be submitted to
the Illinois EPA by the respondent.
That response was due on March 23, 2004.
However, no response was received.
The ACWN also
outlined the necessary corrective
action for cleanup of the site and provided a deadline ofMay
15,
2004 forthat to be
completed.
The ACWN also
required the respondent to
submit copies ofreceipts and/or
manifests that document the proper disposal orrecycling ofwastes by May 20, 2004.
Again, no submittal was received.
The re-inspection shows what appears to be almost
halfas much wastes on the ground at the site than was noted on February 17, 2004, but
there is still approximately
100 cu. yds. of wastes there.
However, most ofthe site’was
covered in snow during the February 17, 2004 inspection, so some ofwhat was perceived
at that time to be wastes in the yard, may have been other non-waste items covered with
snow.
It should be noted that the open burning area observed during the initial site
inspection was not observed during the re-inspection.
Therefore, apparent violations
relative to
open burning will not be alleged based on the re-inspection.
The site is located approximately
1.3 miles south of the Village ofBath, on the east side
of Illinois Route 78.
It is approximately a half-mile south of Township Road 600 N.
The

contains 1.17 acres, more or less.
This is from the Warranty Deed, Book 801, Pages 177
and
178, recorded May 2, 2001.
It was obtained at the Mason County Courthouse,
Havana, Illinois, Recorder’s Office, and
a copy is included as a part ofthis report. The
owner ofthe site is:
Michael Eugene Boone.
His address was previously provided.
He
has no listed telephone number.
Upon arrival at the site on the day ofthe re-inspection, the weather was raining, with an
air temperature ofapproximately
65°
F.
Winds were westerly at approximately 10 mph.
Surface soil conditions were wet and muddy.
During the re-inspection, six photographs were taken with a digital camera.
They show
the conditions ofthe site on the day ofthe inspection.
From the inspection and the
photographs, and the original inspection Site Sketch, a partially computer generated
sketch ofthe site was revised.
It shows
the basic layout ofthe
site, as well as the
approximate locations and directions ofthe inspection photos.
The digital camera assigns
three-digit numbers to eachphotograph, i.e.,
001,
002, etc.
This
is how the photographs
are referred to in this inspection narrative and in the Digital Photographs that accompany
this narrative.
However, to save space on the site sketch, real numbers have been used,
i.e.,
1, 2, etc.
Copies of the Digital Photographs
and the Site Sketc~h
accompany this
narrative as part ofthis report.
Upon arrival at the site on the day ofthe re-inspection, it was still obvious
that the site
was at least partially or up to one-halfcovered with wastes, shown in photographs 001,
002, 003 and 004.
Two apparentlyjunk vans (a light blue Ford Econoline and a black
with silver Ford Areostar),
and a junk Ford pick-up truck were observed as shown whole
or in part in photo #s 001, 002, 003, 004,
005
and 006. Numerous old riding and push
power mowers were about the site.
However, piles ofwood, and sporadic areas of
general household refuse, metals, plastics, cardboard and other wastes were in the area.
Since it was raining, most ofthe re-inspection photos were taken from Illinois Route 78.
I observed wastes at the northwestern end of the site, as shown in photo #as 001
and 006.
An apparent inoperable Ford pick-up truck is partially shown in photo #s 001
and 002.

Two apparently inoperable Ford vans and the wastes between the two junk vans are
shown in photo #s 003
and 005.
That area still measured approximately
12’ x 6’ x 2’
high.
Other visible wastes in that photo include lawn mowers, concrete blocks, metals,
plastics and wood.

side ofthe mobile home are shown in photo #
004.
During the inspection, apparent violations ofthe Illinois Environmental Protection Act
(Act) and the regulations, Title
35,
Illinois Administrative Code, Subtitle G
(35
IAC)
were observed.
Those apparent violations include from the Act, Sections:21(a), 21(d)(1),
21(d)(2), 21(e), 21@)(1)
and
55(a)(1).
An observed apparent violation ofthe regulations,
35 IAC, was Section:
8 12.101(a).
The Open Dump Inspection Checklist that
accompanies this report provides additional information.
OTHER COMMENTS
1.
No one approached me during the re-inspection.
2.
As mentioned, it does not appear that there is as much waste at the site as there
was during the original site inspection on February
17, 2004.
There was an
estimated 189 cu.
yds. ofwastes at the site at that time.
On the day ~f the re-
inspection, approximately 100
cu.
yds ofwastes were still
observed.
3.
As mentioned, due to the rain, most ofthe photos taken during the re-inspection
Were taken from the highway to the west ofthe mobile home.
The former open
burn area was not observed during the re-inspection, and therefore, no apparent
violations regarding open burning will be alleged.
