    ORDER OF THE BOARD (by J. Yi):
    On May 1, 1998, ESG Watts, Inc. (ESG Watts) filed a motion for summary judgment.
    On May 18, 1998, the Illinois Environmental Protection Agency (Agency) filed a motion for
    leave to file instanter its response to petitioner’s motion for summary judgment, accompanied
    by a response. ESG Watts has not opposed the Agency’s motion. The Agency’s motion for
    leave to file instanter is granted, and the response is accepted.
    In light of the Agency’s response to ESG Watts’ status report, the Board notes that
    there is no stay in effect in this case. The Board will consider ESG Watts’ summary judgment
    motion and the Agency response thereto.
    IT IS SO ORDERED.
