HEARING OFFICER ORDER
On June 30, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they remain optimistic that this matter will be
resolved without the necessity of a hearing. The issue that remains is whether the Illinois
Environmental Protection Agency is going to refer another alleged and minor violation. If a
referral is made, the complainant intends to incorporate it in the existing stipulation and proposal
for settlement (stipulation).
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on August 26, 2004, at 11:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a stipulation is filed
prior to the next status conference, the conference will be cancelled without further order.
