HEARING OFFICER ORDER
On June 24, 2004, the complainant informed the hearing officer that penalty calculations
will be forwarded to it from the Illinois Environmental Protection Agency within the next six
weeks. The complainant will then forward its penalty demand to the respondent for its review.
Complainant represented that it anticipates filing a motion for leave to respond and a
response to the remaining affirmative defenses within two weeks.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on August 5, 2004, at 10:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
