HEARING OFFICER ORDER

 

 

  

On June 24, 2004, all parties participated in a telephonic status conference with the

hearing officer. The complainant represented that revised penalty demands have been forwarded

and reviewed by the respondents. It was represented that respondent, The Highlands, L.L.C.

(Highlands) rejected the revised penalty demand. The complainant and Highlands to review the

existing discovery prior to the next status conference and propose a revised discovery schedule if

needed. It was represented that settlement discussions continue with respondent Murphy Farms,

Inc. The attorney for respondent Murphy Farms, Inc. made an oral motion for time to file its

answer to the complainant’s second amended complaint to and including September 9, 2004.

The complainant had no objection. That motion is granted.

 

The parties are reminded that a telephonic status conference with the hearing officer is

scheduled for August 26, 2004, at 10:30 a.m. The status conference must be initiated by the

complainant, but each party is nonetheless responsible for its own appearance. At the status

conference, the parties must be prepared to discuss the status of the above-captioned matter and

their readiness for hearing.
