That Earl and Norma
Martin (“Respondents”) are the present owners and operators
of a facility located at County Road 2500 North, Rio Township,
Knox County, Illinois.
The property is
commonly known to
the Illinois Environmental
Protection Agency as the Martin
Property.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and
is designated with Site Code No.
0958145002.
3.
That Respondents, Earl and Norma Martin,
have owned and operated said facilityat
all times pertinent hereto.
4.
That
on
May 7,
2004,
Jeff Port
of the
Illinois
Environmental
Protection
Agency’s
Peoria Regional Office inspected the above-described facility.
A copy of his inspection report setting
forth the results of said
inspection is attached
hereto and made a part hereof.

VIOLATIONS
Based
upon
direct
observations
made
by Jeff Port during
the course
of his
May 7,
2004
inspection of the above-named facility, the Illinois Environmental Protection Agency has determined
that Respondents have violated the Illinois Environmental Protection Act (hereinafter, the “Act”) as
follows:

That
Respondents
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of
the Act,
415
ILCS 5/21(p)(1)
(2002).
(2)
That
Respondents
caused
or
allowed
the open
dumping
of waste
in
a
manner
resulting
in deposition of waste in standing or flowing waters, a violation of Section
2l(p)(4) of the Act, 415 ILCS
S12l(p)(4)
(2002).
(3)
That
Respondents
caused
or allowed
the open
dumping
of waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction or demolition debris, a violation of Section 21(p)(7) of theAct, 415 ILCS
5/21 (p)(7)
(2002).
CIVIL
PENALTY
Pursuant to
Section 42(b)(4-5) of the Act, 415
ILCS
5142(b)(4-5)
(2002), Respondents are
subject
to
a
civil
penalty of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations
identified
above,
for a
total of
Four Thousand

Narrative
On
May
5,
2004,
DLPCIFOS-Peoria
received
two
complaints
concerning
the
deposition
of
demolition waste into
trenches dug
on
a property near
Rio
owned by
Earl and
Norma Martin.
According to the complainants, Mr. Martin operates a demolition business (Martin Landscaping)
and
the demolition
debris was
from
homes in
Galesburg.
The City of Galesburg had hired Mr.
Martin
to
demolish
the
homes.
The complaints
were
assigned numbers
C-2004-056-P and
C-
2004-057-P.
On May 7, 2004,
I (Jeff Port)
performed an
inspection at the Martin property.
The property
is
located on County Road 2500 North.
The complainants stated that the dump area was not visible
from
the road, but was down a dirt lane to the
south.
I arrived at the site at
10:20 AM.
I was
accompanied
by
Dawn
Ingold,
DLPC/FOS~Peoria.
The
weather
was
overcast
and
warm,
approximately
70
°F. It
had
rained
the
previous
evening
and
standing
water
was
present
throughout the area.
We located the dirt lane and observed tire tracks in the mud
that
appeared
to
be new.
As we drove
down the lane we observed
a large area to
the
east along a
tree line
where soil
had been recently disrupted.
Piles of demolition debris were
also
present here.
As
we
looked
toward
the
south
we could
see
some
vehicles
and
some
heavy
equipment.
We
proceeded
to
this
area.
When we
arrived
at
this
area~we observed
a
dozer and
a
backhoe
operating.
We
quickly
exited
our
vehicle
and
approached
the
equipment.
A
large
trench
appeared
to have been dug in the ground.
Demolition debris was present in the trench.
A
large
pile of soil was located directly south of the trench.
It appeared that the two men operating the
equipment were covering up
the demolition debris
with the soil from the pile.
I was able
to
get
the attention ofone ofthe
men.
He turned offhis engine and asked what I wanted.
I asked the
man if Mr. Martin was available.
The man told us that Mr. Martin was not on site.
I introduced
myself, explained that we were investigating complaints ofdumping and burying of waste from
demolished homes
in Galesburg.
The man got offhis
dozer and waved to the other man.
Both
men then approached
us.
I asked the first man his name.
He said that he was
Rex
Carlson an
employee ofMr. Martin.
The other man identified himself as John Gerk.
I explained to the men
that
what they were
doing
was
in
violation
of several
sections
of the
Illinois
Environmental
Protection Act
and
the Regulations.
Mr.
Gerk said he would attempt to
contact Mr. Martin by
cell phone.
As
he
did I began photographing
the
site.
Photographs

show
the
trench containing the demolition debris.
Photographs P7 through P11 were taken along the edge
of a ravine
to
the southeast
of the trench
area.
A variety of waste was present here including
demolition debris, domestic waste,
and landscape waste.
The soils in this area appeared to
have
been disrupted recently.
Photographs P12 through P19 and P36 show an area to
the west ofthe
ravine where soils also had been disrupted.
It appeared that waste had been buried in this area as
several pieces of demolition debris
and
domestic
waste were
sticking
out of the surface
of the
soil.

When I
returned to the trench, I was told that Mr. Martin was on vacation and was unable to be reached.
Mr. Carlson
and Mr. Gerk said
that
I could contact him on Monday.
I asked them if they had
any
information
concerning where
the
demolition
debris
had
come
from.
Neither of the men
were
willing to
give me any further information.
I suggested
that they both
stop
covering the
waste material and that they leave the site.
I told them that I needed to inspect the rest of the site.

We then proceeded with the inspection ofthe property.
We walked
to the southern portion ofthe
property.
Here
we found several areas where
waste had been dumped.
Some ofthe
waste had
been placed
into
a creek running
through
the property.
The waste
included
demolition debris,
scrap metal, domestic waste,
and landscape waste.
Photographs P23 through

show the waste
in these areas.

We next proceeded back toward the
north.
Here we encountered several junk vehicles
scattered
throughout
the property.
Many of the
vehicles
had Martin Landscaping
logos
on
their doors.

Several
waste
tires
were
seen
throughout the
area.

Both inspectors observed mosquito
larvae swimming in the water.

As
we
finished
photographing
this
area
of the
property,
we observed
Mr.
Carlson and
Mr. Gerk sitting
in a truck at the entrance to this
area.
We entered our vehicle
and
began to
leave this
area.
Mr.
Carlson and Mr. Gerk followed us.
We stopped at an area to
the north of the previously investigated area.
I wanted to
examine the
area that we observed
upon entering the property.

I walked down the east side of the tree line proceeding toward the southeast.
I observed
several
areas along the tree line where
waste
was poking up
through the
soil.
It appeared that
several
loads
of waste
material
had
been dumped
and
buried in
this
area.

intermingled

After photographing this area we proceeded north on the dirt lane and left the property.
Mr. Carlson and Mr. Gerk followed us as we left the site at approximately 11:30 AM.

observed

under this Act.
A violation of Section 12(a) of the

is alleged for the following reason:
By allowing the accumulation ofwaste at
the site, Earl and Norma Martin threatened water pollution in Illinois.

being first duly sworn, voluntarily deposes
and states as follows:

Affiant
is a field inspector employed by the Land Pollution
Control Division of the Illinois Environmental Protection
Agency and has been so employed at all times pertinent
hereto.
2.
On May 7,
2004,
between 10:20 AN and 11:30 AN, Affiant
conducted an inspection of the open dump in Knox County,
Illinois, known as the Martin Property,
Illinois
Environmental Protection Agency Site No.
0958145002.
3.
Affiant inspected said Martin Property open dump site by an
on-site inspection, which included walking and
photographing the site.
4.
As a result of the activities referred to in Paragraph
3
above, Affiant completed the Inspection Report form
attached hereto and made a part hereof,
which,
to the best
of Affiant’s knowledge and belief,
is an accurate
representation of Affiant’s observations and factual
conclusions with respect to said Martin Pr
erty open dump.
