    ORDER OF THE BOARD (by J.P. Novak):
     
    On March 18, 2004, at the parties’ request, the Board extended until June 3, 2004, the
    time period for Pontiac Casey’s, Inc. (Pontiac Casey’s) to appeal a January 29, 2004
    determination of the Illinois Environmental Protection Agency (Agency).

    5/40(a)(1) (2002); 35 Ill. Adm. Code 101.300(b), 105.402, 105.406. The Agency denied
    petitioner’s site investigation plan budget for Pontiac Casey’s leaking underground petroleum
    storage tank facility located at 703 Howard Street, Pontiac, Livingston County. Because
    petitioner failed to timely file an appeal, the Board dismisses this case and closes the docket.
