ORDER OF THE BOARD (by T.E. Johnson):

This matter is before the Board on a petition filed by Kramer Service Station (Kramer)
asking the Board to review a September 5, 2003 determination of the Illinois Environmental
Protection Agency (Agency). The petition was filed in regards to Kramer’s service station
located at 1015 E. Main Street, Danville, Vermilion County.

On June 14, 2004, Kramer filed a motion for voluntary dismissal. In the motion, Kramer
asserts that the matters at the basis of the petition for review have been fully compromised and
settled. Kramer asks the Board to dismiss the petition with prejudice. The motion is granted.
The Board hereby dismisses the petition, and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on June 17, 2004, by a vote of 5-0.
