HEARING OFFICER ORDER
On June 17, 2004, a telephonic status conference was held. Neither party appeared,
however, the petitioner informed the hearing officer on June 18, 2004, that it intends to file a
motion for clarification prior to the next status conference of the December 18, 2003, Board
order where it appears that the petitioner may be appealing the August 6, 2003 high priority
corrective action plan budget rejection (as addressed in the December 18, 2004 Board order), and
the September 8, 2003 partial rejection of the application for payment from the underground
storage tank fund.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on July 22, 2004, at 9:15 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
