    Please be advised
    thatI supportthe request ofthe Madison County
    Mass
    Transit
    District,
    through
    Cassen and Sons,
    to be
    reimbursed
    for clean up
    efforts
    regarding
    the
    construction
    ofthe
    transit
    facility in
    Edwardsville.
    The Transit District provides much
    needed
    transportation to the
    citizens
    ofMadison County, including door to door service,
    fixed
    route
    service and
    Para
    transit
    services forthe general public, the poor, the disabled
    and
    the
    elderly.
    The purpose
    ofthe
    Enviromental
    Protection Act is to provide reimbursement to local
    governments
    such as this whenthey expend
    local
    funds
    forthe
    clean
    up of
    contaminated
    lands.
    Thus,
    I
    believe
    the
    request
    is
    well
    founded
    and
    furthers the intended purposes
    of
    the Act.
    It is my understanding that the funds were
    in
    fact
    expended for eligible purposes, but
    that
    the
    Illinois EPA has
    denied the request based upon a technical notice requirement.
    I
    respectfully request that the Board give
    this
    matter
    the
    usual
    careful consideration
    afforded all petitioners
    in
    such
    matters.
    However,
    it
    is my
    opinion
    that, as
    the project was
    primarily federally
    funded, and
    the
    costs
    were
    eligible, the
    unit
    of local government
    should not
    bear
    the
    burden of
    the
    clean
    up
    costs when
    funds have
    been set
    aside
    for that
    specific purpose.
