Madison County

Mass Transit

Dstrict

through

Cassen and Sons,

to

be

reimbursed

for clean up

efforts regarding

the

construction

ofthetiansit facility in

Edwardsville.

The Transit

District provides

much needed

transportation

to the citizens

of

Madison

County, including

door to door service, fixed

route service and

Para transit

set-vices for the

general

public, the

poor, the disabled and

the

elderly.

Thepurpose

of

the Enviromenlal Protection Act

is to

provide

reimbursement

to local

governments such as this whenthey expend local funds for

the

dean

up

ofcont~iminated

lands.

Thus, I believe

the

request is well founded and furthers

the

intended purposes of

the

Act~

It is my understanding that the funds were in

fact

expended for eligible purposes, but that

the Illinois EPA has denied.the requestbased upon a technical

notice

requirement

I respectfullyrequest that the Board givethis matter the usual careful consideration

afforded all petitioners in such matters. However,

it

is my

opinion

that, as the project was

primarily

federally funded, and the costs

were

eligible, the

unit

oflocal government

should

not bear the

burden ofthe clean up costswhen funds have been set

aside for that

specific purpose..
