    HEARING OFFICER ORDER
     
    On June 8, 2004, the parties participated in a telephone status conference with the hearing
    officer. Respondents’ facility is no longer operating, and the owner is on disability with no
    source of income. Respondents do not have funds to correct the problems, nor are there funds
    for settlement. The parties are awaiting the Board’s ruling on the motion to dismiss before
    taking further action. If the Board does not grant the motion to dismiss, this case will likely
    proceed to hearing.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:00 a.m. on September 9, 2004. The status conference shall be initiated by the
    complainant. At the status conference, the parties must be prepared to discuss the status of the
    above-captioned matter.
