OPINION AND ORDER OF THE BOARD (by J. Theodore Meyer):
This matter comes before the Board upon a four-count complaint filed on December
31, 1996, by the Attorney General of the State of Illinois, on behalf of the People of the State
of Illinois, against Dixon-Marquette Cement, Inc. (respondent), an Illinois corporation and
division of Prairie Material Sales, Inc., located at 1914 White Oak Lane, Dixon, Lee County,
Illinois. The
complaint alleges that
respondent
violated Section 12(f) of the Environmental
Protection Act
(Act) (415 ILCS 5/
12(f) (1996)
) and 35 Ill. Adm. Code 305.102(a) and (b),
309.102(a), and 309.104(a) by discharging effluent without a valid National Pollutant
Discharge Elimination System (NPDES) permit, failing to comply with reporting
requirements, failing to retain records, and failing to comply with NPDES permit conditions.
On April 13, 1998, the parties filed a stipulation, settlement agreement, and a joint
motion requesting relief from the hearing requirement pursuant to Section 31(c)(2) of the Act.
415 ILCS 5/31(c)(2) (1996). The Board published a notice of the request for waiver on April
17, 1998. The Board did not receive any objections to the granting of the waiver.
Accordingly, the Board grants a waiver from the hearing requirement.
The stipulation sets forth facts relating to the nature, operations, and circumstances
surrounding the claimed violations. Respondent neither admits nor denies the alleged
violations, but agrees to pay a total civil penalty of $40,000.
The Board finds the settlement agreement acceptable under 35 Ill. Adm. Code 103.180.
This settlement agreement in no way affects respondent’s responsibility to comply with any
federal, State, or local regulations, including but not limited to, the Act and the Board’s.
This opinion constitutes the Board’s finding of fact and conclusions of law in this
matter.
