HEARING OFFICER ORDER
  
On June 3, 2004, the complainants informed the hearing officer that the respondent is
having internal discussions regarding a revised supplemental environmental project (SEP) to be
incorporated in the settlement. The complainant requested that respondent be given until August
2, 2004, to replead its affirmative defense to
laches
as directed in the March 4, 2004 Board
order. The complainant’s request is granted.
 
The parties are directed to participate in a telephonic status conference with the hearing
officer on July 15, 2004, at 9:15 a.m. The status conference must be initiated by the
complainant, but each party is nonetheless responsible for their own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing.
