    HEARING OFFICER ORDER
     
    On June 1, 2004, the parties participated in a telephone status conference with the hearing
    officer. Complainant has no objection to respondent’s answer to the amended complaint;
    accordingly, the motion for leave to file
    instanter
    is granted. The parties continue to pursue
    settlement of this matter. Respondent is waiting for clarification on one term of its construction
    permit from the Illinois Environmental Protection Agency. Once that issue is resolved,
    respondent will make upgrades to its incinerator, which is not currently operating. Respondent
    will provide financial information to complainant.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:30 a.m. on August 17, 2004. The status conference shall be initiated by the People.
    At the status conference, the parties must be prepared to discuss the status of the above-captioned
    matter.
