HEARING OFFICER ORDER
On May 20, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they continue to exchange settlement offers
regarding a penalty demand and that settlement discussions continue. A draft stipulation and
proposal for settlement is being circulated for review. Respondent made an oral motion for an
extension of time to answer or otherwise plead. Complainant has no objection. Respondent’s
motion is granted. Respondent’s answer or other pleading is now due on or before August 20,
2004.
The parties or their legal representatives are directed to participate in a telephonic status
conference call with the hearing officer on July 29, 2004, at 10:45 a.m. The status conference
must be initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
