HEARING OFFICER ORDER

On May 13, 2004, the petitioner informed the hearing officer that it has recently received

a reimbursement from the respondent and that it will now proceed to additional sampling in

anticipation of a no further remediation letter. Petitioner represented that it will file a waiver of

the statutory decision deadline.

The parties are directed to participate in a telephonic status conference with the hearing

officer on July 15, 2004, at 9:45 a.m. The status conference must be initiated by the petitioner,

but each party is nonetheless responsible for its own appearance. At the status conference, the

parties must be prepared to discuss the status of the above-captioned matter and their readiness

for hearing
