HEARING OFFICER ORDER
On May 6, 2004, a telephonic status conference was held. Respondent did not appear
due to a conflict. The complainant represented that respondent’s supplemental environmental
project (SEP) as part of the settlement has been rejected. However, the respondent may have
other SEP options. The complainant requested that respondent be given until June 24, 2004, to
replead its affirmative defense to
laches
as directed in the March 4, 2004 Board order. The
complainant’s request is granted.
The parties are directed to participate in a telephonic status conference with the hearing
officer on June 3, 2004, at 11:30 a.m. The status conference must be initiated by the
complainant, but each party is nonetheless responsible for their own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing.
