HEARING OFFICER ORDER
On May 4, 2004, all parties participated in a telephonic status conference with the
hearing officer. By agreement, respondent’s record of its determination is due to be filed on or
before November 5, 2004. Petitioner represented that it will file a waiver of the statutory
decision deadline to and including January 15, 2005. In the interim, the parties will have on-
going discussions regarding a resolution of this permit appeal.
On April 6, 2004, the petitioner filed the petition and, among other things, requested a
stay of certain conditions. On May 4, 2004, the respondent represented that it has no objection
to petitioner’s request for a stay and that it will not file a response.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on July 22, 2004, at 11:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
