HEARING OFFICER ORDER
On April 29, 2004, a telephonic status conference was held. Respondent did not appear,
but called later. Petitioner represented that the related to an enforcement matter that is also
before the Board is in its final stages of settlement. Once the enforcement matter is resolved,
petitioner anticipates that it will file a motion to voluntarily dismiss the above-captioned matter.
Petitioner requested that this matter be scheduled for another status conference in 60 days.
Petitioner’s request is granted. Petitioner represented that it will file a 60-day waiver of the
statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on July 1, 2004, at 9:30 a.m. The status conference must be
initiated by the petitioner, but each party is nonetheless responsible for its own appearance. At
the status conference, the parties must be prepared to discuss the status of the above-captioned
matter and their readiness for hearing.
