HEARING OFFICER ORDER
On April 22, 2004, all parties participated in a telephonic status conference with the
hearing officer. Complainant made an oral motion to reply to respondent’s response to the
complainant’s motion to strike or dismiss respondent’s affirmative defenses. Respondent had no
objection. Complainant’s motion is granted and its reply is due to be filed on or before May 14,
2004. Complainant represented that the Illinois Environmental Protection Agency is still in the
process of determining a penalty demand.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on June 24, 2004, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
